1. Ordering & Payment

I am currently booked out several months in advance for custom orders. Please feel free to enquire about my schedule via email at amber.rose@yellowscreations.com before you place your order.

I do not personally handle any of your banking information. If you have any questions regarding payment, please do not hesitate to contact me.

If you would like to pay via PayPal, please contact me ahead of time. There is an additional 3% processing fee.

If you opt for direct bank transfer, please be aware that your order will only be processed and shipped after the payment has been transferred to our account. This may cause a delay in the delivery of your order, compared to using other immediate payment options. After completing the order and payment, your purchase will be shipped within a maximum of seven working days when it’s in stock and ready to ship. If there will be a delay in shipping due to Yellow Monkey v.o.f. being out of the studio for any reason at the time of placing the order, the client will be notified as soon as possible of the delay.

Once an order is placed, an email confirmation will be sent to the customer.

If you place a custom order the payment method will be decided during the design process. For custom or made-to-order pieces, the estimated production time will be discussed with the client before production, please note, production times vary from piece to piece and are subject to change. In the event of an incorrect price listing, Yellow Monkey v.o.f. reserves the right to cancel the order and refund the customer’s money, even if the payment has already been made.

On your bank statement the payment will be made to Yellows Creations YM or Yellow Monkey vof depending on the payment method.

2. Shipping & Delivery

All orders purchased through this website are shipped from Belgium

Pottery: Orders that contain pottery only will be shipped out within 7 business days, as these pieces (if ordered directly from the site) are ready to ship. Shipping time for made to order pieces will be discussed with the client before the order is placed.

Jewelry: At the moment all jewelry is made to order. Please contact me with your design idea, during this process, expected shipping times will be discussed.

Mixed orders: If you purchase pottery and jewelry you can choose to have the pottery shipped separately for an added fee. You will be contacted to discuss this.

I ship through Bpost, PostNL or UPS depending on your location. Other shipping methods can be discussed.

A tracking code is not always provided, if you desire one please choose the correct shipping method. If you choose a method without a tracking code you accept the risks of possible lost packages. Packages lost that did not have a tracking code can only be replaced at the clients expense.

All jewelry orders are shipped with insurance, at the clients expense, there are no exceptions.

Pottery orders above 200€ are shipped with insurance at the clients expense, no exceptions.

General Notice of Disruption

Due to the general disruption in shipping whether it be caused by pathogen, war, lack of personnel or acts of Mother Nature, estimated shipping times are unknown. In most situations they are running smoothly, but please be patient as there may be delays with receiving your order. You will be notified of any estimation on shipping time in a confirmation email. These estimations are based off of previous shipments and are not the standard or guaranteed. Thank you.

Taxes & Fees

The CLIENT is responsible knowledge of and subsequent payment for any customs fees, import taxes, VAT, or any duty taxes imposed on the buyer by their country of residence associated with their purchase; I have no control over this. If you are unfamiliar with your countries import taxes, please do your due diligence before purchasing. In most cases, there is a maximum that is allowed tax free.

I can not be held responsible for any taxes and fees incurred. I will not falsify customs declaration forms in order to help a buyer avoid these taxes and fees; this is illegal. WE WILL NOT BREAK THE LAW; PLEASE DO NOT ASK US TO DO SO.

Shipping Rates:

A word on shipping: Shipping is never free

If a company is offering free shipping it is because of several factors:

1.) The price of shipping has been added to the price of the items, usually a portion so that if you purchase 1 item they make a loss but several items cover the shipping and then some.

2.) These items are massed produce and purchased at incredibly low prices and resold with higher profit margins than a handmade company can sell at.

3.) These companies are large and shipping high volumes, they receive INSANE discounts on shipping that small businesses can not compete with.

So, no shipping is not free. I have decided not to hide the price of shipping in the products for sale. Unfortunately, shipping is expensive, especially outside of Belgium and its border countries.

The prices you see are what it costs and I can't do anything about it. You have the option of without tracking or with tracking. Tracking is much more expensive.

20 - 30 KG is the max a single box can be shipped depending on the destination. Any orders above this will be split into multiple packages. If you are are planning on placing a large order, I recommend contacting me before hand for shipping prices.

3. Bespoke orders / Custom made orders

Bespoke pottery and jewelery (custom made orders) will always be unique in design whether it’s in the big or in the small details. Designs may be similar but always vary with factors such as texture, size or stone. Custom orders will be designed by Yellow's Creations (Yellow Monkey v.o.f.) by the guidance of the customer. The process for this takes up time because of the consultation, search for the right materials, design and production time is all unique. During this process you will be informed about the estimated time schedule. Please be considerate of ongoing projects with my work as well as time for my personal life. Please be aware that I am currently books out for several months.

Jewelry: Before placing an order, please make sure you know your correct size or discuss with me about being sized. To guarantee a perfect fit I suggest paying a visit to my atelier or a local jeweler where the size can be measured correctly. Note that I communicate and measure in European sizing. In case the custom ring with the provided size (not sized by me) doesn’t fit due to a wrong measurement, resizing is not a free service.

Resizing will be assessed possible with most jewelry, however not recommended with rings that have texture (due to breaking the textured pattern) or with rings with a stone (due to a risk for the stone). This is why I highly recommend getting the ring size measured properly in either a local jeweler or in my atelier.

Pottery: If a specific size is required for the pieces, please keep in mind that clay has a shrinkage rate that differs across different clays and is also subject to variations within the same clay depending on the hydration level of the clay at the time of production. While I try to control these factors as best I can, I am not a robot, therefore a perfect size is not always possible. Please allow for variations due to the organic nature of the material and human interpretation.

A prepayment for the custom order will be asked in advance, this will serve as a deposit to secure the order and start producing it. The rest of the payment will be asked after production. The custom order will be shipped out or available for pickup, when the full price has been paid.

If there’s a deadline for your custom order, such as a wedding date for example, please share this information. A minimum of four months notice is needed to guarantee the desired products for a custom order. If your deadline is sooner than two months, I’m willing to try my best and give priority for your order – if possible – for an extra fee of 20% on the final price. These terms are not a standard and are subject to change in different situations, therefore it is advised to contact me ahead of time.

Yellow Monkey v.o.f (Yellow's Creations) is obliged to hold on to the non-refundable deposit and custom piece a year from the agreement on the custom order. If after a year of the deposit the custom piece has not been paid fully, the deposit will expire and the finished piece of jewelry will either be put up for sale or will be recycled. Of course hopefully you are able to fully finish the custom order and enjoy your bespoke Yellow's Creations piece.

4. Return policy

Right of withdrawal with remote purchase for the pottery and jewelry website and webshop according to the FPS Economy (Belgium):

This is the case of a contract concluded between a company and a consumer, within the framework of an organized system of distance sales or services, without the simultaneous physical presence of the company and the consumer, using exclusively one or more means of distance communication (telephone, Internet, catalog, etc.), up to and including the moment the contract is concluded.

As a consumer, you have the right to revoke your purchase and cancel the contract without giving reasons, in accordance with Belgian law and the European Directive 2011/83/EU on consumer rights. I, Yellow Monkey v.o.f., hereby make available to you the following right of withdrawal:

Right of withdrawal:

You have the right to revoke the purchase of the jewelry or pottery ordered within a period of fourteen (14) days without giving reasons, starting from the day after the delivery of the product.
Returning collection pieces will only be accepted if you return the piece in perfect condition and in the original packaging. Jewelry that has been worn and/or damaged will not be accepted back. Pottery obvious signs of use and/ or damage will not be accepted back.

Exercise of the right of withdrawal:

To exercise your right of withdrawal, you must notify Yellow Monkey v.o.f., in writing of your decision to withdraw from the agreement within the aforementioned period. This can be done via email to amber.rose@yellowscreations.com with added photo’s of the state of the piece. You can use this model form (PDF, 253.7 KB) (in Dutch) for withdrawal, but this is not obligatory.

Consequences of withdrawal:

If you withdraw from this contract, I shall reimburse to you all payments received from you, including the costs of delivery (except for any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and in any event not later than fourteen (14) days from the day on which we receive notice of your withdrawal from this contract.

I may withhold reimbursement until I have received the goods back or you have supplied evidence of having returned the goods, whichever comes first.

You’ll return or hand over the goods to me without undue delay and in any event not later than fourteen (14) days from the day on which you communicate your decision to withdraw from the contract to us. You are in time if you return the goods before the period of fourteen (14) days has expired.

The consumer shall bear the direct costs of returning the goods.

Exclusion of right of withdrawal:
The right of withdrawal is excluded for:

Products that are manufactured according to your specifications or have a clearly personal character: custom orders and bespoke jewelry pieces.
Products that are not suitable to be returned for reasons of health protection or hygiene and whose seal has been broken after delivery. The product must be unworn, in its original condition without damage and in its original packaging.
Yellow's Creations (Yellow Monkey v.o.f. giftcards / vouchers.
Products that after delivery are by their nature irrevocably mixed with other items.
Products purchased in person.

Yellow's Creations (Yellow Monkey v.o.f. is not responsible for any delays, damage or loss once the package has been handed over to the postal service by you.

Handmade pieces are offered and even though quality is my main priority, production mistakes are not excludable. Yellow Monkey v.o.f. reserves the right to deny unreasonable repairs, returns and replacements.

5. Guarantee

A guarantee of 6 months from the date of purchase is granted on all Yellow's Creations (Yellow Monkey v.o.f.) items. When a piece breaks or shows a sign of needed repair, the customer may send it back if the guide care has been followed to treat the piece of jewelry or pottery well. In all cases of pottery or jewelry, the expertise of the creator from Yellow Monkey v.o.f. will be decisive on the break or damage, items that are treated badly will not be covered by the free of charge repair guarantee. Repairs that are covered by the guarantee with normal wear, will be free of charge with the exception of the shipping costs. In case a damaged piece is assessed as irreparable, the option for a replacing gift voucher will be offered.
The customer must contact amber.rose@yellowscreations.com as soon as possible after the damage, with the maximum time period of 1 month after breaking, within the 6 months guarantee deadline; whichever comes first. Please always inform me of the complaint by including photos or a video of the piece before returning the item.

Yellow Monkey v.o.f. offers a repair service for damages after the six months guarantee period as well for a variable price, depending on the item and needed repairs.

The guarantee does not apply to any cracks in gemstones that occur, since the production of them is not Yellow Monkey v.o.f. but Mother Nature herself. Gemstones can be fragile products by nature so the responsibility for endurance is with the wearer. If your stone is damaged and you’re looking for a solution, do feel free get in touch and Yellow Monkey v.o.f. will help for a suitable solution to help fix it. Jewelry or pottery sent back for repairs must be shipped back to Yellow Monkey v.o.f. with a trackable package and in the original packaging.

If you receive an item that was damaged due to mishandling from the shipping company, please take photos of the packaging before opening, contact first the shipping company then me. What will and can be done will be determined on a case by case basis.

6. Gift Vouchers

Gift vouchers are valid for 24 months from the date of issue or date of purchase, whichever comes second. (Example: if you purchase a gift card for someone else and select a delayed delivery date, the expiry date will be 24 months from the date the recipient receives it, but should you purchase a gift card with no delayed delivery date the expiry date is 24 months from the purchase date)

Unused values will not be refunded or attributed to any transactions after the expiry date.

Gift vouchers can be redeemed against all products only at www.yellowscreations.com.

Gift vouchers cannot be redeemed for cash, returned for a refund, have their balances consolidated to a new voucher, or replaced after expiry. They are not legal tender, account cards, credit or debit cards, or securities.

If your purchase exceeds the value of the gift voucher, the balance must be paid by cash, debit or credit card.

If you return any products you have purchased using a gift voucher, the balance will be credited to you as a credit note and is to be redeemed against subsequent purchases.

Gift vouchers cannot be replaced if lost or stolen. If you suspect an unauthorized activity, immediately report this to Yellow's Creations via email amber.rose@yellowscreations.com providing all details including proof of purchase, gift voucher number and a photo ID for verification purposes.

Yellow's Creations (Yellow Monkey v.o.f.) reserves the right to cancel a gift voucher if we deem such action necessary. If so, we may either provide a replacement gift voucher of equivalent value unless we suspect fraud in relation to a gift voucher. The gift voucher remains our property.

Yellow's Creations (Yellow Monkey v.o.f.) can vary or replace these conditions from time to time (including to introduce new fees)

7. Jurisdiction Clause

These general terms and conditions apply to all agreements between Yellow Monkey v.o.f, located at Torhoutsesteenweg 66A, Belgium, and the customer using the services of the webshop.

Applicable law

All disputes arising from or related to the agreement between the webshop and the customer, including its interpretation, shall be governed by Belgian law, to the exclusion of the rules of international private law.

Competent courts

All disputes arising from or related to the agreement between the webshop and the customer, including its interpretation, shall be submitted exclusively to the competent courts in Bruges, Belgium.

Exceptions

Nothing in this jurisdiction clause shall prevent the customer from seeking interim relief from a competent judicial authority before a dispute is brought before the competent courts in Bruges, Belgium.

Other Provisions

a. This jurisdiction clause takes precedence over any other jurisdiction clause that would conflict with this clause.
b. This jurisdiction clause applies to all agreements between the Webshop and the Customer, including future agreements.
c. If any provision of this jurisdiction clause is deemed invalid or unenforceable, this shall not affect the validity and enforceability of the remaining provisions.

The customer agrees to these terms and conditions by using the webshop’s services.
